Recognition and Procedural Agreement
Between
Chorley Taxi Association Ltd (CTA)
And
The Trade
1. Definition of Terms
In this Agreement:
CTA – Refers to Chorley Taxi Association Ltd
Trade – Refers to all members joined under CTA
Taxi – Refers to both hackney/private hire drivers and taxi operators
Stakeholders – Refers to third parties such as the Police, Chorley Council, and Lancashire County Council
2. Commencement Date
2.1 The commencement of this agreement shall be the date of the trade member’s first payment to CTA.
3. Objectives and General Principles
3.1 Acceptance of services shall be deemed as acceptance of these conditions of service and confirmation of satisfaction with becoming a member. CTA endeavours to represent members and provide support where deemed appropriate within the resources available.
3.1.2 The purpose of this Agreement is to:
Establish recognition and representation within the organisation.
Create a framework for consultation and collective bargaining.
Provide support to members holding a valid Taxi Driver’s License or Operator’s License within the jurisdiction of Chorley. Members operating outside this jurisdiction will have to pay for any service.
3.2 Members must have identified common objectives they wish to pursue, which include:
3.2.1 Establishing a relationship of mutual respect, support, and partnership with CTA.
3.2.2 Providing effective and prompt resolution of issues and disputes.
3.3 CTA will support and guide members to protect the interests of the trade. All discussions and shared information shall remain private and confidential. Members are equally bound to maintain confidentiality.
4. CTA Meetings and Other Facilities
4.1 Meetings of members will be held quarterly.. All meetings shall remain private and confidential.
4.2 The following matters shall be subject to consultation and negotiation:
Taxi licensing issues
Council-related matters
Trade issues
Any other matters mutually agreed upon by both parties
4.3 CTA agrees that consultation with stakeholders and negotiation on relevant issues shall be conducted promptly and in good faith, with the aim of reaching an agreed settlement within the boundaries of licensing conditions.
5. Payment and Price
5.1 Payment is to be made via Faster Payment, Credit Card, or Debit Card unless otherwise agreed.
All credit card transactions require address verification (billing address). Incorrect billing details may result in delayed or cancelled transactions.
5.2 Any work undertaken by CTA on behalf of a member shall be charged at the current National Minimum Wage rate. Annual membership fees paid will be treated as a credit balance, from which time spent on support or representation will be deducted accordingly.
If the total time spent exceeds the value of the membership credit, the additional time will be charged separately at the National Minimum Wage rate. Any money earned from such work will be donated to a good cause approved by the CTA Committee. No member, director, or officer of the association shall personally receive or retain any of this money.
6. Membership Card
6.1 A membership card will be issued upon joining CTA. If membership is cancelled, the card must be returned within 7 days. Failure to return the card will incur a charge of £10 per month until the card is received by CTA.
6.2 In the event the membership card is lost or stolen, CTA must be informed immediately. A replacement card will be issued at a cost of £10.00.
7. Cancellation and Refund
7.1 Members have a 14-day cancellation period (“cooling-off period”) from the date of joining.
If cancellation occurs after the 14-day period, no refund will be issued. CTA reserves the right to refuse or terminate membership at any time.
7.2 Membership may be cancelled at any time, without notice, following a majority vote by the CTA Board Members. Decisions made by the Board in relation to membership termination shall be final.
8. General Terms
8.1 This Agreement is binding upon both CTA and its members from the commencement date.
8.2 CTA reserves the right to review, amend, or update these terms as required, with notice provided to members.
8.3 All parties agree to act with fairness, professionalism, and integrity in accordance with the objectives of this Agreement.
